Welcome to NSM Prime Media Group

These Terms of Service ("Terms") govern your use of the NSM Prime Media Group website and services. By accessing or using our services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access our services.

NSM Prime Media Group provides digital marketing services including but not limited to: web development, app development, e-commerce development, SEO optimization, content marketing, graphic design, video production, and sponsored advertising campaigns.

Service Delivery: All services are provided according to the specifications outlined in individual service agreements or proposals. Timelines and deliverables will be clearly defined in writing before work commences.

Client Responsibilities: Clients must provide necessary access, content, feedback, and approvals in a timely manner to ensure project success and adherence to agreed timelines.

Fees: All fees are outlined in individual service agreements. Pricing is subject to change with 30 days' notice for ongoing services.

Payment Schedule: Payment terms vary by service type. Typically, a deposit is required before work begins, with final payment due upon project completion or monthly for ongoing services.

Late Payments: Late payments may incur a fee of 1.5% per month or the maximum allowed by Nevada law. NSM Prime reserves the right to suspend services for accounts with overdue balances.

Refund Policy: Refunds are handled on a case-by-case basis. Work already completed is non-refundable. Please refer to individual service agreements for specific refund policies.

Client Ownership: Upon full payment, clients receive full ownership of custom work products created specifically for them, including websites, logos, and custom graphics (excluding third-party licensed assets).

NSM Prime Assets: NSM Prime retains ownership of proprietary tools, frameworks, code libraries, and methodologies used in delivering services.

Portfolio Usage: NSM Prime reserves the right to display completed work in portfolios, case studies, and marketing materials unless otherwise agreed in writing.

Third-Party Assets: Some deliverables may include third-party licensed assets (stock photos, fonts, plugins). Clients are responsible for maintaining valid licenses for such assets.

NSM Prime Media Group respects the confidentiality of all client information. We will not disclose confidential client information to third parties without consent, except as required by law or necessary to provide services (e.g., hosting providers, payment processors).

Both parties agree to maintain confidentiality of proprietary business information, trade secrets, and sensitive data shared during the course of the business relationship.

Support Hours: Our standard business hours are Monday-Friday, 10 AM - 8 PM PST. Emergency support may be available for clients with maintenance agreements.

Response Times: We strive to respond to all inquiries within 24 business hours. Critical issues are prioritized based on severity.

Maintenance: Ongoing maintenance and support services are available through separate maintenance agreements. Standard project delivery does not include ongoing maintenance unless specified.

Warranties: We warrant that all services will be performed in a professional and workmanlike manner. Websites and applications are warranted to be free from critical defects for 30 days post-launch.

NSM Prime Media Group's total liability for any claim arising from services provided shall not exceed the total amount paid by the client for the specific service giving rise to the claim.

In no event shall NSM Prime be liable for indirect, incidental, consequential, or punitive damages including lost profits, lost revenue, or lost data, even if advised of the possibility of such damages.

We are not responsible for third-party platform changes (Google algorithm updates, social media policy changes, etc.) that may affect campaign performance.

Termination by Client: Clients may terminate ongoing services with 30 days' written notice. One-time project termination will result in charges for work completed to date.

Termination by NSM Prime: We reserve the right to terminate services immediately for non-payment, breach of terms, or abusive behavior toward staff.

Post-Termination: Upon termination, clients will receive all completed work products upon payment of outstanding balances. Access to NSM Prime tools and platforms will be revoked.

These Terms are governed by the laws of the State of Nevada without regard to conflict of law provisions.

Dispute Resolution: Any disputes arising from these Terms or our services shall first be attempted to be resolved through good-faith negotiation. If resolution cannot be reached, disputes shall be resolved through binding arbitration in Las Vegas, Nevada in accordance with the American Arbitration Association rules.

Venue: Any legal action related to these Terms must be brought in the state or federal courts located in Clark County, Nevada.

NSM Prime Media Group reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Continued use of our services after changes constitutes acceptance of the modified Terms.

For material changes affecting existing service agreements, we will provide 30 days' notice via email.
